Yes illegal, there are allot of players who being using this, there for allot of them are banned.
I don't think there is some kind of rule for, there should be..
Don't do it, if you get 'caught', you will get blocked :)!.
See this rule.

2.3. It is forbidden to profit from discovered errors in game algorithm, as well as any game actions, obviously not supposed by the service. In case of discovering a bug, please write about it at the corresponding forum branch or contact the Administration directly.
"Supposed" should read "intended" and "write about" should read "report" but the meaning of the rule is clear. Players should not exploit "bugs" to benefit their character.

Can you back up that statement with some links? I assume you mean "blocked", not "banned".
Yes give me some link
Why is it illegal?

how is not getting exp a profit
Because not getting exp is an advantage in this game. Not levelling up means you're getting stronger without needing to level up. Difficulties won't increase, other players your level will be weaker than you, etc.

A lot of the game balance problems ARE because people don't level
ok thx

Yes I mean blocked, and yes I can show you some links. If you check Technical questions you'll find topics about players being blocked for this. I'm to lazy and tired to go look for the topics, so have fun! ;D
I agree with Geryon. The 2.3 rule can't be applied here, 'cause it's not a bug.

Bug definition: (wikipedia)
A software bug is the common term used to describe an error, flaw, mistake, failure, or fault in a computer program or system that produces an incorrect or unexpected result, or causes it to behave in unintended ways

Admins made it in this way, and, I don't think someone will get blocked just for doing it. There is no rules against it (at least, I can't see none).
Or maybe you just wouldn't admit that you made things up.

Stop whinning in every topic I respond trying to make me look like a moron.
At the beginning of the tourney there were several threats in thechnical questions, about a dwarf lvl 3 who'd won like 4 times and got no exp doing this.

There were all kind of people responding to that threat and eventaully the dwarf got blocked.

@ Geryon, I would like you to stop responding at all of my topics. Forum is for everyone, so back down and stop pretending I don't know anything.

I'm 100% certain there was a threat like this, i'm not someone who comes at the forum every day, but this is something I'm really sure of..
If that person is still blocked today, I do not know, all I know is at the beginning of the tourney there was a topic about this and a lvl 15 player said at the end of the threat something like 'Well look, seems like you have you're answer' and the Dwarf lvl 3 was blocked.

For all I know, he was blocked for using that 'bug' at Survival Tourney.
I also thought of the merc-loophole when I read this thread,* and the non-blocks after quite a few players admitted openly that they (ab)used this loophole.

Still, without discussing the way rule are(n't) enforced, I guess a loophole falls under the any game actions, obviously not supposed by the service-part, otherwise you wouldn't call it a loophole in the first place.

* with a D at the end, Arcanide... not to point to a mistake, just saying it to avoid confusion... a threat is something else ;)
This topic is long since last update and considered obsolete for further discussions.
