The answer is: It depends on if it was a honest mistake or not. And that warrants investigation. Though it would tend towards illegality, there is a chance it is not.

If both of them are not multis, then I guess it's legal. Apparently, it's legal. It all depends on the buyer (but I don't think he's that dumb).
